Terms of sale
Last updated: 23 octobre 2026
This English version is provided for convenience. The French version is the legally binding one; in case of any difference, the French text prevails.
1. Plans and content
| Plan | Price | Photos | Searches / month | Deep searches / month |
|---|---|---|---|---|
| Free | €0 / month | 3 | 6 | — |
| Creator | €12 / month | 100 | 150 | — |
| Pro | €39 / month | 1,000 | 2,400 | 15 |
| Agency | €99 / month | 5,000 | 6,000 | 40 |
The frequency of automatic monitoring, evidence screenshots and the other features of each plan are described on the pricing page. Quotas are reset on the 1st of each month and do not roll over. Automatic monitoring is spaced out for photos that return no results.
2. Prices
VAT not applicable under Article 293 B of the French Tax Code: prices shown are net prices. The applicable prices are those displayed at the time of subscription. The Publisher may change its prices for the future. The Customer is informed by e-mail at least 30 days before a new price applies to their subscription, and may cancel before that date at no cost.
3. Ordering
The Customer chooses a plan from their account. A summary shows the plan, its monthly price and the cancellation terms. The Customer accepts the Terms of Sale, requests immediate performance of the Service (Article 6), then clicks the “Order with obligation to pay” button (Article L221-14 of the French Consumer Code). They are then redirected to the secure payment page of our provider Stripe, which repeats this obligation to pay. The order is final once payment is confirmed. A confirmation e-mail and the invoice are sent to the Customer.
4. Payment
Payment is made by card or any other method offered by Stripe (Stripe Payments Europe, Ltd.). The Publisher never has access to card numbers. The subscription is payable in advance, each month, on the anniversary date of the subscription.
5. Term, renewal and cancellation
The subscription is for one month, renewed automatically each month, with no minimum commitment. The Customer may cancel at any time, online in two clicks (Article L215-1-1 of the French Consumer Code): the “Cancel my subscription” button in Settings → Plan, also reachable from the “Cancel my subscription” link at the bottom of every page, then “Confirm cancellation”. An e-mail confirms the cancellation and its effective date. Cancellation takes effect at the end of the current monthly period, already paid, and no further payment is taken. The Customer may also cancel by e-mail at support@frolay.com. The account then returns to the Free plan and data is kept within the limits of that plan.
The Customer may change plan at any time. Stripe adjusts the amount pro rata.
6. Right of withdrawal (consumers)
Under Article L221-18 of the French Consumer Code, a consumer Customer has 14 days from subscription to withdraw, without giving any reason. To do so, they send a clear statement (for example: “I withdraw from my Frolay Protect subscription taken out on …”) to support@frolay.com, or use the form below.
When subscribing, the Customer expressly requests that the Service start immediately, before the end of the withdrawal period. If they withdraw, they only pay for the service provided until withdrawal, pro rata (Article L221-25 of the French Consumer Code). The rest is refunded within 14 days, using the same payment method.
To Thomas DELION, 4 rue Henri, 60750 Choisy-au-Bac, France, support@frolay.com:
I hereby give notice that I withdraw from the contract for the Frolay Protect subscription (plan: …), taken out on … .
Name: … — Account e-mail address: … — Date: … — Signature (if sent on paper)
The right of withdrawal does not apply to business Customers.
7. Failed payment
If a payment fails, Stripe retries it and the Customer is asked to update their payment method. If payment still fails, the subscription is cancelled and the account returns to the Free plan. For business Customers, any sum unpaid when due incurs late payment interest equal to three times the French statutory interest rate, plus a fixed recovery fee of €40 (Articles L441-10 and D441-5 of the French Commercial Code).
8. Performance of the service
The Service is available as soon as payment is confirmed. The Publisher’s obligations and the limits of its liability are described in the terms of use. Search results depend on third-party services: the Publisher undertakes to carry out the search, not to find a minimum number of uses.
9. Legal guarantee of conformity (consumers)
A consumer Customer benefits from the legal guarantee of conformity for digital content and services (Articles L224-25-12 et seq. of the French Consumer Code) throughout the supply of the Service. In the event of a defect, they may ask for the Service to be brought into conformity. Failing that, they may obtain a price reduction or the termination of the contract. They simply write to support@frolay.com.
10. Invoices
Invoices are issued by Stripe on behalf of the Publisher and are available at any time in the billing area (Settings → Plan). No VAT charged (French micro-business scheme).
10a. Online licence payments and commission
The Customer may add a “Pay for the licence” button to their letters. To do so, they open a payment account with Stripe (Stripe Connect), subject to Stripe’s terms. The site using the image pays by card on a secure page; Stripe pays the sum directly into the Customer’s account. The Publisher never holds the funds.
For this service, the Publisher receives a commission deducted automatically from each payment received, according to the Customer’s plan at the time of payment: Free 15%, Creator 12%, Pro 10%, Agency 8%. No commission is due on sums the Customer collects by other means, except for managed recovery (Article 10b). The Customer alone is responsible for invoicing the licence to the payer and for their tax obligations.
10b. Recovery managed by Frolay
Where this service is offered, the Customer may entrust a case to the Publisher by accepting an out-of-court recovery mandate in the application. The Publisher then sends, on the Customer’s behalf, the settlement request and up to two reminders, and replies to the site. The site pays directly into the Customer’s payment account. In return, the Publisher receives a commission of 25% of the sums collected for that case, deducted from the online payment or invoiced if the Customer is paid another way. Nothing is due if nothing is recovered. The mandate excludes any legal action and may be revoked at any time; the commission remains due on sums paid as a result of steps already taken. The Publisher may decline a case.
11. Personal data
Data needed for ordering and invoicing is processed in accordance with the privacy policy.
12. Force majeure
Neither party is liable for a failure caused by force majeure within the meaning of Article 1218 of the French Civil Code.
13. Changes to the Terms of Sale
The applicable Terms of Sale are those accepted at subscription. If they change, the Customer is informed at least 30 days in advance and may cancel at no cost before the change takes effect.
14. Customer service
For any question or complaint: support@frolay.com — 0782820847 — by post: 4 rue Henri, 60750 Choisy-au-Bac, France. We reply within 5 working days.
15. Mediation and disputes
In the event of a dispute, a consumer Customer first sends a written complaint to customer service. If no solution is found within 30 days, they may refer the matter free of charge to the consumer mediator (Article L612-1 of the French Consumer Code): ..., ... — .... Consumers in the EU may also use the European Commission’s dispute resolution resources.
These Terms of Sale are governed by French law. This choice does not deprive a consumer of the protection of the mandatory rules of the country where they habitually reside. A consumer may bring proceedings, at their choice, before the court of the place where they lived when the contract was concluded or where the harmful event occurred. For business Customers, the courts with jurisdiction over the Publisher’s registered address have exclusive jurisdiction.
